Where possible, this website bases its presentation on court records, filings, and documented sources. It distinguishes between party assertions, record contents, and court findings.
Methodology
Not every statement in a court record is a court finding. Motions, responses, exhibits, and decisions are therefore identified on this website according to their respective role.
Court records, decisions, and filings form the principal basis of this presentation.
Riechmann’s allegations, the State’s responses, and court findings are not treated as equivalent.
Conflicting accounts or information are not reconciled without supporting evidence.
Source references use the physical PDF pages of the files reviewed, which may differ from page numbers printed within the documents.
Including a document or statement does not mean that everything it contains is treated as an established fact.

Primary source · Record on Appeal
The Record on Appeal filed on January 27, 2025, contains 498 PDF pages. It includes, among other materials, Riechmann’s 2024 habeas corpus petition, related exhibits, the trial court’s 2024 decision, and Germany’s amicus curiae brief.
Use: A central source for the presentation of the 2024–2025 proceedings and for many of the evidentiary and procedural issues discussed on this website.

Primary source · Appendix to the appellate record
The Appendix, file-stamped March 26, 2025, contains 87 PDF pages and supplements the materials reviewed from that appellate proceeding.
Use: It is used where it provides additional documents or context for the appellate record.

Primary source · Supplemental procedural materials
The State’s motion filed on March 27, 2026, to supplement the record, together with its attachments, contains 269 PDF pages. The materials include, among other things, a State response from 2024 and earlier court decisions.
Use: It is used primarily to place later procedural developments and the State’s position in context.
D
Secondary source · Documentary
The documentary “Todesstrafe für eine Lüge – Der Fall Dieter Riechmann” includes, among other things, recorded statements by participants, experts, and a former juror.
Use: It is used as a supplementary source, particularly for documented statements and historical context. Statements from the documentary are treated as statements by the respective individuals and are not equated with court findings.
References such as “R, PDF pp. 193–213” refer to the physical page sequence of the relevant PDF file. Internal or printed page numbers may differ. Where pages are missing or jumps are apparent within a file, missing content is not reconstructed or filled in by inference.
Guide
They document which motions were filed, which decisions were issued, and which procedural steps can be traced in the record.
They contain the parties’ respective legal and factual positions. Those positions are identified as party assertions and are not automatically treated as facts.
Parts of the record contain declarations, reports, and other exhibits that later arguments about evidence and witness testimony rely on.
In 2005, Germany filed an amicus curiae brief with the Florida Supreme Court. It addressed, in particular, issues concerning the obtaining and use of evidence from Germany in connection with proceedings in which a death sentence had originally been imposed.
The court’s acceptance of the brief did not mean that it adopted Germany’s legal position or found Riechmann innocent.
The documentary supplements the written record with recorded statements. It remains a secondary source and, where possible, is checked against the primary-source materials.
Including a source does not mean that every statement it contains is adopted or treated as established. Where records contain differing accounts, those differences are identified.
Parts that have not been fully reviewed, are missing, or are difficult to read are not filled in by speculation. The original documents remain controlling.
